1. Agreement to Terms

All listing information is deemed reliable but not guaranteed, and should be independently verified.

REALVISOR DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALVISOR AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold harmless RealVisor, its affiliates, agents, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, violation of these Terms, or infringement of any rights of a third party.

12. Dispute Resolution and Arbitration

Any disputes between you and RealVisor shall be governed by the Federal Arbitration Act and resolved by binding arbitration on an individual basis in accordance with the rules of the American Arbitration Association (AAA). You and RealVisor each waive any right to participate in a class action, jury trial, or representative proceeding. Arbitration hearings will take place in San Antonio, Texas, unless otherwise agreed in writing. Either party may seek interim injunctive relief in court to preserve the status quo.

You may reject this arbitration provision by sending a written notice to RealVisor Realty, LLC – Attn: Arbitration Rejection, 9690 Crow Ln, Adkins, TX 78101 within 30 days of first agreeing to these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time, without notice, for conduct we believe violates these Terms or is otherwise harmful to RealVisor or its users.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Venue for any permitted court action shall be in Bexar County, Texas.

15. Updates to These Terms

We may modify or update these Terms at any time. Changes are effective upon posting on this page. Continued use of the Services after changes constitutes acceptance of the revised Terms.
